On April 15, 12 of the 13 journalists who were released on March 31 in a trial regarding the alleged media arm of the group purportedly behind the July 15 coup attempt were rearrested on serious allegations.
 
The recent arrests have brought the number of journalists in prison to 153. The full list can be viewed here.
 
The arrest ruling came in the early hours of April 15, following a full day of courthouse processes during April 14. The 13 journalists were held at the detention center on İstanbul’s Vatan street until their arrest.
 
News editor of the Zaman newspaper Ali Akkuş was the only journalist released in the new investigation, however he will also be tried on the new charges. Former Habertürk coordinator Abdullah Kılıç , Meydan columnist Atilla Taş, Aksiyon reporter Bünyamin Köseli, Bugün reporter Cihan Acar, Türksolu columnist Gökçe Fırat Çulhaoğlu, Cihan reporter Hüseyin Aydın, former Yeni Şafak columnist Murat Aksoy, Bugün daily’s news editor Mustafa Erkan Acar, Habertürk former coordinator Oğuz Usluer, TRT Haber’s Seyid Kılıç, Aktif Haber news website editor-in-chief Yetkin Yıldız and Zaman reporter Yakup Çetin were arrested on charges of “attempting to overthrow the constitutional order” and “attempting to overthrow the government of the Republic of Turkey.”
 
The journalists were released by a decision of the Istanbul 25th High Criminal Court on March 31, only to be detained anew within a few hours, following tweets condemning the ruling posted by pro-government individuals. The panel of judges that made the ruling was suspended on April 3. In Antalya, five journalists were detained and arrested after their release in a similar fashion. Reports on the most recent status of the Antalya journalists have been contradictory, with some stories claiming they were all rearrested while others naming some of the suspects as “fugitives.” These journalists currently have “under arrest” status on P24’s list of imprisoned journalists.
 
Reasons for arrest
 
Media reports have stated that the 13 journalists were referred to court on April 14 by Istanbul Chief Prosecutor İrfan Fidan on charges of membership in the Fethullah Gülen network, which Turkish authorities claim orchestrated the coup attempt of July 15. The prosecutor stated in the referral document that the suspects “that there is reasonable doubt of evidence that [the suspects] were part of the media arm of the [Fethullah Gülen] organization during, before and after the coup attempt with the purpose of creating public approval [of the coup]; [and they] actively worked for the organizations that belong to the organization, they fulfilled their duties as agents of influence, and participated in the act of seizing the Republic of Turkey by disrupting the constitutional order and attempting to overthrow the government of Republic of Turkey.”
 
A total of 21 journalists were released by the Istanbul 25th High Criminal Court on March 21. An objection filed by the prosecutors to the release ruling was accepted for eight journalists, and the 13 who were recently arrested were detained.
 
 
Aggravated life sentences for journalists
 
A new indictment into 17 people, including journalists Ahmet Altan, Mehmet Altan, Nazlı Ilıcak, Ekrem Dumanlı, Emre Uslu, and Tuncay Opçin was submitted to a Turkish court on April 14.
 
Six of those charged are currently in prison, ten have “fugitive” status while one is on probation. The suspects are all accused of “attempting to overthrow the government” and “attempting to eradicate the parliament” and they face three counts of life sentences without the possibility of parole.
 
The document claims that journalists Ahmet Altan, Nazlı Ilıcak and Mehmet Altan, who participated in a television program aired one night before the coup attempt, made statements “that contained coup-related associations.”
 
Those who were indicted in the document are: Kerim Balcı (capture warrant), Ahmet Altan (under arrest), Ali Çolak (capture warrant), Nazlı Ilıcak (under arrest), Bülent Keneş (capture warrant), Ekrem Dumanlı (capture warrant), Emre Uslu (capture warrant), Faruk Kardıç (capture warrant), Fevzi Yazıcı (under arrest), Mehmet Kamış (capture warrant), Mehmet Altan (under arrest), Osman Özsoy (capture warrant), Şükrü Tuğrul Özşengül (under arrest), Tibet Murad Sanlıman (released pending trial), Tuncay Opçin (capture warrant), Yakup Şimşek (under arrest).

ECtHR to treat Cumhuriyet application as priority
 
On April 13, Cumhuriyet reported that the European Court of Human Rights (ECtHR) had decided to treat an application for the imprisoned writers and executives of the Cumhuriyet daily as a priority case. This doesn’t mean the court will necessarily accept the application, but it indicates that the court will review the examination sooner than it would have been under regular circumstances. The court had given the same decision before in the case of several applications from Turkish journalists Ahmet Altan, Mehmet Altan, Atilla Taş and Murat Aksoy.
 
Foreign journalist deported
 
Le Jour announced that its reporter Olivier Bertrand was detained at Istanbul’s Sabiha Gökçen airport and subsequently deported on April 13. The newspaper said Bertrand’s name was on a list of “unwanted” journalists.
 
 
Detentions and trials of journalists
 
On April 13, police detained Berivan Altan, a reporter for the shuttered DİHA news agency in Mersin province. Officials didn’t name the reason why Altan was being kept in custody.
 
On April 13, Evrensel journalists Çağrı Sarı and Mehmet Arif Koşar appeared before a court on charges of violating Article 301 of the Turkish Criminal Code, which criminalizes insulting security forces and other state organs. The trial was adjourned until June 6.
 
Access bans and violations of right to information
 
On April 14, media reports indicated that 46 news reports providing information on the outcome of criminal cases where the suspects were accused of insulting President Recep Tayyip Erdoğan online were blocked.
In another access ban, the news website sendika.org was closed by an access ban for the 27th time. A news story on the 28th version of the site reported that on April 13, 13 people were detained in operations conducted by the police into social media posts. Being detained or even arrested after sharing a critical tweet or post on tip-offs from “concerned citizens” is increasingly common in Turkey. According to data from Anatolia News agency, which runs completely on public money but has an openly pro-government stance, about 18,000 such social media posts awaited judicial proceedings as of January this year.
