A large number of journalists appeared before courts on Feb 14 and Feb 15

On Feb. 14 and Feb. 15, many journalists and writers appeared in court in the OdaTV, Özgür Gündem and Taraf trials. Additionally, journalist Hasan Cemal was given a jail sentence for an interview with a Kurdistan Workers’ Party (PKK) member.
On Feb. 14, twenty-two people, including journalists, artists and politicians were in court as part of a trial being heard by the 22nd High Criminal Court on supporting the shuttered Özgür Gündem newspaper by standing in as an editor-in-chief for a day, as part of a campaign to show solidarity with the newspaper.
No verdict came out of the session, but the prosecutor demanded jail sentences for most of the defendants. For the linguist Necmiye Alpay, the prosecutor asked for up to 10.5 years in prison on charges of “spreading propaganda on behalf of a terrorist organization” and “publishing statements from a terrorist organization.” Alpay spent three months in prison in connection with the trial.
The prosecutor asked for 7.5 years for Journalist Yıldırım Türker, who also stood in as an editor-in-chief for Özgür Gündem for a day, on similar charges. The prosecutor also asked for a prison sentence for Hasan Cemal, who was the editor-in-chief of Özgür Gündem for an entire day on June 15, 2016.
Also on Feb. 14, another trial regarding Özgür Gündem, was heard by the 13th High Criminal Court. The trial, where the newspaper’s managing editor has been arrested since Aug. 22, 2016, was adjourned to May 9.
OdaTV trial adjourned until April
Thirteen defendants, including journalists Ahmet Şık, Nedim Şener, Soner Yalçın and Yalçın Küçük as well as former Police Chief Hanefi Avcı was heard on Feb. 15 by the İstanbul 18th High Criminal Court.
This was the 9th session in the OdaTV trial. Journalist Ahmet Şık, who is under arrest facing terror-related charges in another case, was also in the courtroom. “My journalistic activities are once again under investigation,” he said.
The prosecutor has asked for the acquittal of all suspects in the trial. The session was adjourned until April 12.
Hasan Cemal given prison term for interview
Journalist Hasan Cemal, a columnist for the news website T24 and the founding president of Platform for Independent Journalism (P24) was also at court on Feb. 14, facing up to 9.5 years on charges of “spreading terror propaganda” in an interview with PKK member Fehman Hüseyin, published on July 11, 2016. The court sentenced Cemal to one year and three months in prison. The sentence was suspended.
Court rejects officers’ request for intervention in Taraf case
Former Taraf newspaper executives and journalists Yasemin Çongar, Ahmet Altan, Yıldıray Oğur, Tuncay Opçin and Mehmet Baransu were tried on Feb 15 in the third hearing of a court case launched in relation to the alleged publication of military documents several years ago, was held on Wednesday at the İstanbul 13th Assize Court.
Retired military officers Bilgin Balanlı, Halil İbrahim Fırtına, Ahmet Yavuz, Ahmet Türkmen, Ayhan Taş, Nejat Bek, Erdem Caner Bener, colonels Osman Fevzi Güneş, Yüksel Gamsız, Ali Cengiz Şirin, Erdal Akyazan, Recai Elmas, Erdoğan Koçoğlu, Hasan Nurgören and Behçet Alper Güney had asked the court to intervene as co-plaintiffs in the case, based on “possible damage caused by the offence.” The court rejected that request in Wednesday’s hearing, saying they have not been “directly harmed by the offence.”
Similar requests by retired General Çetin Doğan and retired Colonel Nedim Ulusan were accepted during the first hearing of the trial on Sept. 2, 2016, allowing their lawyer, Hüseyin Ersöz, to attend all hearings of the case since then.
The documents in question, titled the Egemen Operation Plan — although more commonly known by the public to be concerning documents about the Balyoz (Sledgehammer) coup plan, were published by Taraf in 2010.
One journalist acquitted in presidential insult trial
Ali Ergon Demirhan, an editor from the news website sendika.org was acquitted on Feb. 15 in a trial where he was accused of insulting the Turkish president.
The charges were brought against the editor in relation with a news story about a retired teacher saying “You will drown in the blood you’ve shed,” words addressed to President Recep Tayyip Erdoğan.
The judge ruled that a degree of reasonable doubt couldn’t be established to prove that an act of insult had taken place.
On Feb. 15, Pir News Agency reporter Diren Keser, who had been held in custody since Feb. 2 in Mersin province, was let go on probation terms. Pir News Agency said officials hadn’t offered any explanation as to the reasons behind Keser’s detention.
Reports on media
The Council of Europe’s commissioner for human rights, Nils Muiznieks, issued a stark warning about deterioration in media freedom and freedom of expression in Turkey on Feb. 15, saying it “represents an existential threat to Turkish democracy” and calling for measures to restore freedoms, including the lifting of the state of emergency.
Muiznieks said the recent decline in freedom of expression came about in a very difficult context — right after a coup attempt and amid deadly attacks by various terrorist groups — but added that “neither the attempted coup, nor other terrorist threats faced by Turkey can justify measures that infringe media freedom and disavow the rule of law to such an extent.”
According to P24’s figures, 153 journalists are in prison as of Feb. 16.
Hürriyet censors interview with Pamuk
On Feb. 14, the independent news website T24 reported that an interview conducted with Pamuk, slated for publication on Feb. 13 in Hürriyet — one of Turkey’s highest circulation dailies — was not published because it included criticism of a proposed constitutional amendment.
The report claimed that Hürriyet’s newly appointed Washington Bureau Chief Cansu Çamlıbel interviewed Pamuk, but the editorial board decided to forgo the piece, on the grounds that it included remarks from the Nobel laureate that were against the proposed changes.
In an email statement to the P24-led Susma Platform, the author confirmed that the story was true. “The news is unfortunately true,” Pamuk said, adding that Çamlıbel had conducted a lengthy interview with him. He said he was also asked a question about whether he would vote in favor of the proposed amendments. “I said I was going to vote ‘No’ and explained the rationale behind my decision. In the end, the interview wasn’t published.”
