Indictment into Cumhuriyet executives submitted to court; custody period for detained journalists extended

On April 4, Turkish prosecutors submitted an indictment to a court against 19 Cumhuriyet executives, journalists and lawyers.
The indictment, drafted by the İstanbul Chief Prosecutor’s Office, accuses 17 of the 19 suspects of “aiding a terrorist organization without being its members.” The case of journalist Ahmet Şık, who was arrested in December 2016, was merged with the main Cumhuriyet trial.
The indictment lists columns and news reports by the journalists under trial, as well as tweets by the daily’s executives as “elements of crime.” The indictment also accuses the journalists of “having had phone conversations with ByLock users,” a little-known application which Turkish authorities say was used by the Fethullah Gülen network — the community allegedly behind the July 15 account — until early 2016.
Sentences sought
The prosecutor demands between 7.5 to 15 years of imprisonment of Ahmet Şık, accusing of “helping the armed terrorist organizations PKK and DHKP/C, despite being a member” of either of the organizations.
For former Cumhuriyet Editor-in-Chief Can Dündar and Editor-in-Chief Murat Sabuncu; columnists Kadri Gürsel, Aydın Engin, Bülent Yener and Günseli Özaltay, the prosecutor asked between 7.5 and 15 years in prison on charges of “aiding an armed terrorist organization without being its members.”
The indictment seeks between 11.5 to 43 years of imprisonment for Cumhuriyet newspaper’s Executive Board President Akın Atalay and members Mehmet Orhan Erinç and Önder Çelik on charges of “aiding an armed terrorist organization without being its members” and “abusing power derived from one’s position.”
For Bülent Utku, cartoonist Musa Kart, Hakan Karasinir, Mustafa Kemal Güngör and Hikmet Aslan Çetinkaya, the indictment demands between from 9.5 to 29 years on charges of “aiding an armed terrorist organization without being its members” and “abusing power derived from one’s position.”
19 of the 12 defendants in the case are under arrest, while five others are pending trial outside prison. The prosecutor also sought an arrest warrant for İlhan Tanır, who lives in the US, and for Can Dündar, who currently resides in Germany.
More Cumhuriyet detentions
On April 7, Cumhuriyet’s Finance Manager Emre İper was taken into custody at a midnight raid on his home by police. Earlier, a motorcycle courier working for Cumhuriyet, Yavuz Yakışkan, had been detained.
Detention period for 13 journalists extended
The Istanbul Prosecutor’s office has extended the custody period for the 13 journalists who were detained in a new investigation hours after being released by a court in the coup investigation on April 1 for an additional seven days.
In a related development, the judges who served on the panel of the Istanbul 25th High Criminal Court, which ruled for the release of 21 journalists who have been under arrest in the coup investigation, were temporarily suspended. Similarly, three journalists in Antalya province, who were released in early April in a coup-related trial, were taken into custody and subsequently arrested on April 3. Those arrested include Antalya Zaman reporter Tuncer Çetinkaya and local news website owner Olgun Matur.
Other detentions
Ahmet Boltan, a distributor for the Kurdish Rojeva Media newspaper, was detained in Diyarbakır province on April 1.
On April 6, the Ankara Chief Prosecutor’s Office announced that it had detained 38 employees of the state-owned Turkish Radio and Television (TRT) network under suspicion of ties with the Fethullah Gülen network.
On April 4, a court issued a capture warrant for Önder Öner, an editor for the Etkin News Agency. The police were unable to locate Öner during a search of his residence.
Trials and investigations of journalists
The Istanbul 8th Criminal Court of First Instance issued a total of TL 113,000 in fines to journalists who were employed by the Özgür Gündem daily, which was shut down under a Cabinet decree. Those fined include the former Editor-in-Chief Eren Keskin, the Managing Editor Reyhan Çapan and editor Ersin Çaksu.
Hamza Aktan, a news editor for the shuttered İMC news website, was acquitted by a Bakırköy court on April 4 in a trial where he was accused of “spreading terror propaganda” over some of his tweets.
Cemil Uğur and Halil İbrahim Polat, two Evrensel reporters, who were detained earlier while covering a riot in Mersin province with Uğur remaining under arrest for three months, were on trial on April 3. The session was adjourned until June 12.
DİHA reporter Mehmet Güleş, who was arrested on Dec. 7, 2016, who risks up to 22 years in prison, appeared before a court for the first time on April 3 in Elazığ. The court ruled to keep the arrest ruling for Güleş in place.
Another DİHA reporter, Ziya Ataman, also appeared before a court on April 3. Ataman wasn’t released in the trial. The trial was adjourned until July 5.
DİHA journalist Ömer Gül, who was detained in country-wide operations in 2015, was sentenced to 4.5 years in prison.
Jiyar Cihanferd and Hassan Balada, two Kurdish-Iranian writers who were detained in Turkey’s Mardin province in January, will appear before a judge on April 10. The two writers were arrested on charges of membership of the Kurdistan Workers’ Party (PKK).
An investigation was launched into local Giresun journalist Ali Dursun on charges of “insulting the president and the prime minister” in his social media posts and news reports. Dursun testified to police during an interrogation at the Görele Police Department in Giresun.
Şujin reporters Zeynep Turgut and Nişmiye Güler, who were earlier taken into custody in Tatvan, were let go on April 7.
German officials visit Yücel
On April 4, German Minister of State for Europe Michael Roth visited Deniz Yücel, a Die Welt reporter who is under arrest, in Silivri Prison. Roth said German officials were still trying to secure the release of Yücel.
Access bans
ON April 4, the Turkish Telecommunications Board (BTK) blocked access to sendika.org, a left-wing news website and to Dihaber’s website.
